As part of Asiabina Group’s day to day business, we collect your Personal Information when you apply to purchase a property with us, register interest to any of our products or services or communicate with us. In return, we may use this information to provide you with our products or services, maintain our records or send you relevant information.

 

FULL PRIVACY NOTICE

This Privacy Notice outlines the approach of Asiabina Group of Companies including its subsidiaries, associates, jointly controlled, and/or managed entities and affiliates (collectively known as “Group”) with regards to the collection, usage, disclosure, and processing of Personal Data in respect of transactions with the Group.

The Group respects and upholds the privacy of individuals with regard to personal data. 

This Privacy Notice is formulated in accordance with the Personal Data Protection Act 2010 (“Act”).  In this Privacy Notice, “Personal Data”, “collect”, “use”, “disclose” and “process” shall have the same meanings as defined in the Personal Data Protection Act 2010 [Act 709] (“PDPA”) (as may be amended from time to time) and its corresponding regulations, standards, guidelines, notices and/or practices issued thereunder.

In this Notice, “we” shall refer to any of the companies within the Group and “you” shall refer to yourself and such other persons or companies represented by you of which you are providing the Personal Data.

 

  1. COLLECTION OF PERSONAL INFORMATION

1.1 In the course of your dealings with the Group, you may have furnished your Personal Data to the Group and in doing so, you acknowledge and confirm that you are providing to us accurate, complete, not misleading and up-to-date Personal Data and further agree and consent to the Group collecting, using, disclosing, processing and retaining your Personal Data with the Group, its officers and/or employees shall not be liable for any inaccurate, incomplete, misleading or not up-to-date Personal Data provided by you.

1.2 In the event you furnish or make available to the Group any Personal Data relating to a third party, including. information of spouse, children, parents, directors, shareholders and/or guarantors (collectively the “Relevant Persons”), you represent and warrant that you have obtained the consent of the Relevant Persons for you to provide the Group with their Personal Data, which are accurate, complete, not misleading and up-to-date; and for the Group to collect, use, disclose, process and retain their Personal Data for the relevant purposes.

1.3 Notwithstanding the foregoing, the Group is not required to verify the accuracy and completeness of the Personal Data provided by you and the Group is entitled to treat the Personal Data provided by you as accurate, complete, not misleading and up- to-date.

1.4 Personal Data about you which we or the Group may collect via print and digital channels (including but not limited to Website, Social Media and Mobile Apps) shall include:

  1. a) information collected upon registration when you fill in or update your information with us, which may include personal data (such as name, identity card number, passport number, date of birth, age, gender, race, nationality), contact details and any other relevant information that you have disclosed to the Group depending on the nature of dealings or transactions (as may be updated from time to time);
  2. b) the contents of all printed and electronic forms or documents submitted to us via printed collateral or forms, the Group’s Website and any digital and mobile platforms (eg. Email, Facebook, Twitter, Instagram, Whatsapp, Viber and any social media and apps), including identity documents and proof of address;
  3. c) information collected when you / your representatives / employers submit completed forms, applications (including job applications) and/or documents to the Group;
  4. d) personalisation preferences you select as you use the Group’s Website, digital and mobile platforms;
  5. e) information submitted if you participate in survey, events, contests, market research whether via online or otherwise;
  6. f) any messages or comments you submit to us via the Group’s Website or in whatever manner, which may include personal data such as name, email address and telephone number;
  7. g) information obtained independently by the Group from other lawful sources; and
  8. h) the contents of all forms and/or documents submitted and/or collected by the Group.
  9. i) when you make payment related to any transaction with the Group
  10. j) when you visit our premises in person, g. sales galleries, offices or show units, through security or CCTV recordings;
  11. k) other purposes where you have provided us with information.
  1. OBJECTIVE OF PERSONAL DATA COLLECTION

2.1 Personal Data provided to the Group whether via online or otherwise, you hereby agree that the Group shall collect, process, disclose, retain and use the Personal Data for the following purposes:-

  1. a) considering and processing your application for and providing you with products and/or services of the Group as well as products and/or services by third party service providers provided through the Group; and/or
  2. b) providing you with services or benefits under any of the Group’s businesses or policies, including but not limited to communicating with you including responding to queries, requests and/or complaints; and/or
  3. c) where relevant, marketing of services and sending any updates, new development, special offers, advertising, promotional material and/or commercial material to you by way of postal mail to your address(es) and/or electronic transmission to your email address(es), text messages (SMS/MMS), telephone calls and/or other phone based messaging to your telephone number(s); and/or to be used in, to provide and/or improve the services of the Group, processing invoices and payments (including card payments) and providing other services to enhance and support the relationship of the Group and you and/or such other persons or companies represented by you; and/or
  4. d) conducting research on planning, products, goods, services, security and testing; and/or
  5. e) carrying out matching procedure in accordance with the law; and/or
  6. f) performing statistical analysis for various objectives in the Group and providing this information within the Group; and/or
  7. g) purposes connected with the operation, administration, development, record-keeping or enhancement of the Group’s business including for the purpose of which is relevant to support and/or assist in any of the Group’s businesses or the Group’s Website; and/or
  8. h) purposes connected with the administration, management and/or enforcement of the commercial transaction and for contact and communication with you and/or such other persons or companies as represented by you; and/or
  9. i) where required by law, where the Group considers that such use or disclosure is necessary to respond to any claims or legal process, or where the Group suspects that fraud or unlawful activity has been, is being or may be engaged in and for prevention and detection of crime including without limitation to money laundering, terrorism and fraud prevention, detection and prosecution; and/or
  10. j) where a third party acquires or wishes to acquire, or makes inquiries in relation to acquiring, an interest in any company within the Group; and/or
  11. k) where a third party requires in order for such third party to perform functions or services as required by the Group; and/or
  12. l) enabling the Group or where a third party requires in order for such third party to perform functions or obligations as required under the laws, rules, regulations, by laws and/or guidelines (whether or not having the force of law) or as required by any governmental and/or non-governmental authorities, agencies or departments or a third party requires in order to ensure compliance with agreement(s) or document(s); and/or
  13. m) conducting credit / trade checks and other background checks on you and where applicable, any Relevant Persons with any registered credit reporting agency at any time for the purpose of processing a transaction with the Group or for as long as any dues remain unpaid and outstanding with the Group; and/or
  14. n) where a third party requires in order for purposes of preparation and submission of any claims or payments to any party or for any audit/checks by any party for whatever purpose related to the Group’s business; and/or
  15. o) purposes connected with the enforcement of the Group’s rights pursuant to any letter, agreement and/or document including seeking legal and financial advice, taking any preliminary steps or commencing any legal action; and/or
  16. p) making such disclosures as may be required for any of the above purposes or by law or required by government authorities or otherwise in compliance with laws, rules, regulations, by-laws, orders, guidelines and/or directives issued by the relevant authorities; and/or
  17. q) facilitating the Group’s customers loyalty programmes, customer relations events and activities; and/or
  18. r) for any other purposes that is incidental or ancillary or in furtherance to the Group’s purposes; and/or
  19. s) updating your personal data; and/or
  20. t) facilitating, implementing and/or formalising any transaction with the Group; and/or
  21. u) facilitating any transaction with the Group, which may include opening of utility accounts, registering ownership, and managing and maintaining of common property; and/or
  22. v) facilitating business transactions which may include mergers, acquisitions or asset sales; and/or
  23. w) compliance with internal policies and procedures, including without limitation, risk management, product planning, insurance, audit and other administrative purposes; and/or
  24. x) for all ancillary purposes relating to the provision of facilities including the provision of computer, telecommunications and technology services; and/or
  25. y) human resource applications; and/or
  26. z) any other incidental purpose relating to any of the above or any transaction with the Group

2.2 We may either contact you for the purpose as set out in (2) above via telephone calls, emails, short message services, social media or by whatsoever form of available communication.

 

  1. DISCLOSURE

3.1 You further agree that the Group may disclose and transfer (whether in Malaysia or abroad) amongst any company within the Group and/or to third parties including but not limited to the Group’s agents, insurers, consultants, utility companies, solicitors, auditors, employers, contractors, suppliers, partners, joint venture partners, advertisers, purchasers, network operators, service providers, associated companies, any registered credit reporting agencies under the Credit Reporting Agency Act 2010 [Act 710], any relevant authorities (governmental/non-governmental) , embassies, statutory bodies, regulatory bodies, organisations or any relevant financial institutions, business partners, investors, assignees or transferees to facilitate business asset transactions (including without limitation to any merger, acquisition or asset sale), any other persons under a duty of confidentiality to the Group or any company within the Group, any of the companies within the Group, (including those established or incorporated from time to time), actual or proposed assignees or transferees or buyers of any of rights/businesses/assets of the companies within the Group, service providers (including those who assist us in providing/developing/maintaining the Group’s Website and digital platforms), for the Group’s operational, administration and development requirements and to organizations who provide archival, auditing, professional advisory, debt collection, insurance, banking, marketing, advertising, mailhouse, delivery, recruitment, call centre, technology, research, utility, loyalty programme and security services to use, disclose, hold, process, retain or transfer such Personal Data for the purposes of (2) above for and on behalf of Group.

3.2 The Group uses and discloses aggregated non-personally identifying information collected by us as part of the Group’s process of constantly improving the Group’s Website, our business and/or the Group’s business.

 

  1. IMPACT OF INSUFFICIENT & INCOMPLETE PARTICULARS OF PERSONAL DATA

4.1 Please note that in the event that sufficient Personal Data is not supplied, or is not satisfactory to the Group then your application or request to the Group for any of the above purposes as set out in (2) above may not be accepted or acted upon or your request to browse some information on the Group’s Website may be denied or the Group will not be able to provide the full range of benefits and/or services and/or perform its obligations under any potential or existing contract with you.

 

  1. STORAGE AND RETENTION OF THE PERSONAL DATA

5.1 Your Personal Data shall be stored either in hard copies in the Group’s offices or stored in servers located in or outside Malaysia and operated by the Group or its service providers in or outside Malaysia.

5.2 Any Personal Data supplied by you will be retained by the Group as long as necessary for the fulfillment of the purposes stated above or is required to satisfy any legal, regulatory and/or accounting requirements or to protect the Group’s interests.

5.3 The Group does not offer any online facilities for you to delete your Personal Data held by the Group.

 

  1. HANDLING EMAIL AND “CONTACT US” MESSAGES

6.1 The Group may preserve the content of any email or “Contact us” or “Register” or other electronic message that the Group receives.

6.2 Any personal data contained in those messages will only be used or disclosed in ways set out in this Privacy Notice.

6.3 The message content may be monitored by the Group’s service providers or employees for purposes including compliance, auditing and maintenance or where email abuse is suspected.

 

  1. COMMUNICATION OR UTILIZATION DATA

7.1 Through your use of telecommunications services to access the Group’s Website, your communications data (e.g. Internet protocol address & respective Groups WIFI facility) or utilization data (e.g. information on the beginning, end and extent of each access, and information on the telecommunications services you accessed) are technically generated and could conceivably relate to Personal Data.

7.2 To the extent that there is a compelling necessity, the collection, processing and use of your communications or utilization data will occur and will be performed in accordance with the Act.

 

  1. AUTOMATICALLY COLLECTED NON-PERSONAL DATA

8.1 When you access the Group’s Website, the Group may automatically (i.e., not by registration) collect nonpersonal data (e.g. type of Internet browser and operating system used, domain name of the website from which you came, number of visits, average time spent on the site, pages viewed).

8.2 The Group may use this data and share it with the rest of the Group to monitor the attractiveness of the Group’s Website and to improve their performance or content.

 

  1. COOKIES

9.1 When you view the Group’s Website, the Group may store some data on your computer in the form of a “cookie” to automatically recognize your personal computer the next time you visit.

9.2 Cookies can help the Group in many ways, for example, by allowing the Group to tailor a website to better match your interests or to store your password to save you from having to re-enter it each time.

10.1 Personal Data held by the Group will be kept confidential in accordance with this Privacy Notice pursuant to any applicable law that may from time to time be in force.

10.2 Any questions, comments, suggestions or information other than Personal Data submitted to us in whatever manner (including those sent or posted in the Group’s Website) will be deemed voluntarily provided to the Group on a non-confidential and non-proprietary basis.

10.3 The Group reserves the right to use, reproduce, process, collect, disclose, transmit, publish, broadcast and/or post elsewhere such information freely as set out in (3) above.

 

  1. PERSONAL DATA SAFETY

11.1 The Group uses a number of mechanisms to protect the security and integrity of your Personal Data.

11.2 For the Internet, unfortunately, no data transmission over the internet can be guaranteed as completely secure. So while the Group strives to protect such Personal Data, the Group cannot ensure or warrant the security of any Personal Data transmitted to the Group and you do so at your own risk. Once any Personal Data comes into the Group’s possession, the Group will take reasonable steps to protect that information from misuse and loss and from unauthorised access, modification or disclosure.

11.3 A username and password may be essential for you to use some sections of the Group’s Website. For your own protection, the Group’s requires you to keep these confidential and to change your password regularly (if required).

14.2 If you have any questions regarding this Privacy Notice or if you wish to request access to your Personal Data or if you wish to correct your Personal Data or if you wish to withdraw your consent to the Group for the processing of your Personal Data for the purposes as set out in (2) above or for the transfer of your Personal Data to the parties stated in (3) above, you may send your request in writing to the following address:

14.3 Please note that notwithstanding the withdrawal of your consent, the Group may still proceed to process your Personal Data in circumstances recognized and permitted by law and as required under the contractual conditions.
